Terms of Service
1. Acceptance of Terms
By accessing or using GB7 Social ("the Platform," "we," "us," or "our"), operated by GB7 Holding, you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Platform. These Terms form a binding agreement between you and GB7 Holding.
2. Eligibility
You must be at least 16 years old to create an account and use GB7 Social. By registering, you represent that you meet this age requirement and that all information you provide is accurate and complete. If you are under 18, you confirm that you have your parent's or guardian's consent.
3. Your Account
- You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
- You must notify us immediately at hello@gb7social.com if you suspect unauthorized access to your account.
- You may not create more than one personal account. Business and creator profiles must be designated as such.
- Accounts are non-transferable.
4. User Content
You retain ownership of all content you post on GB7 Social ("User Content"). By posting, you grant GB7 Holding a worldwide, non-exclusive, royalty-free, sublicensable license to use, display, reproduce, distribute, and process your User Content solely for the purpose of operating and improving the Platform.
You represent and warrant that:
- You own or have the necessary rights to post your User Content.
- Your User Content does not infringe any third-party intellectual property, privacy, or other rights.
- Your User Content complies with applicable law and our Community Guidelines.
You may delete your User Content at any time. Residual copies may remain in backups for a limited period, and content you shared with others may remain visible to them.
5. Prohibited Conduct
You may not use GB7 Social to:
- Post content that is unlawful, harmful, hateful, threatening, abusive, defamatory, obscene, or otherwise objectionable.
- Harass, bully, stalk, or intimidate other users.
- Impersonate any person, organization, or entity, or misrepresent your affiliation.
- Distribute spam, unsolicited advertising, or chain messages.
- Upload malware, viruses, or any destructive code.
- Scrape, crawl, or harvest user data without our written consent.
- Circumvent or attempt to circumvent any security feature of the Platform.
- Use the Platform to promote illegal activities or solicit participation therein.
- Post content involving the sexual exploitation of minors (CSAM). Such content will be immediately removed and reported to relevant authorities.
6. Intellectual Property
All content, features, and functionality of GB7 Social — including but not limited to the software, design, graphics, logos, and trademarks — are the exclusive property of GB7 Holding and are protected by German and international intellectual property law. You may not copy, modify, distribute, or reverse-engineer any part of the Platform without our prior written consent.
7. Privacy
Your use of the Platform is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data. Our Cookie Policy explains our use of cookies.
8. Third-Party Services
The Platform may integrate with or link to third-party services (e.g., Spotify, Apple Music, YouTube, Giphy). Your use of those services is subject to their own terms and privacy policies. GB7 Holding is not responsible for the content or practices of any third-party service.
9. Disclaimers
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not warrant that the Platform will be uninterrupted, error-free, or free of harmful components.
GB7 Holding does not endorse any User Content and expressly disclaims all liability for User Content posted by third parties.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GB7 HOLDING SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS OR DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM. OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED €100 OR THE AMOUNT YOU PAID US IN THE PRECEDING TWELVE MONTHS, WHICHEVER IS GREATER.
Nothing in these Terms limits liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.
11. Termination
You may delete your account at any time from your account settings. We may suspend or terminate your account immediately if you violate these Terms, with or without notice. Upon termination, your right to use the Platform ceases. Provisions that by their nature should survive termination (e.g., intellectual property, disclaimers, limitation of liability) will survive.
12. Governing Law & Jurisdiction
These Terms are governed by the laws of the Federal Republic of Germany, without regard to its conflict-of-law provisions. Any disputes shall be resolved exclusively in the courts of Berlin, Germany, unless mandatory consumer protection law in your country of residence provides otherwise.
If you are a consumer in the EU, you may also benefit from the mandatory provisions of the consumer protection laws of your country of residence.
13. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes via in-app notification or email at least 14 days before the changes take effect. Your continued use of the Platform after the effective date constitutes your acceptance of the revised Terms. If you do not accept the changes, please delete your account before the effective date.
